Divorce can be nasty
Sometimes one spouse will try to gain the upper hand in divorce proceedings by having the other declared as some type of criminal or to possess some moral flaw. The false allegations are a nasty tactic.
The important thing if this happens is not to go to defend yourself in court, but to call us and have us work through the process. You might be able to have the charges dismissed and expungement to clear your name. You might also be able to prove the allegations were false and that the other spouse misuse the court system.
Some spouses will claim the other beat the children. They might say they acted inappropriately in sexual ways to keep them from getting custody. They might claim that you have anger issues or don’t pay your bills. This might just be a way to gain custody or improve their alimony or child support payments.
The bigger problem is not that you might not get custody or have to pay more after the divorce. It’s that you might go to jail and therefore have your life ruined. False allegations are illegal and should be addressed in the proper manner.
